AGREEMENT TO POLICIES, PAYMENTS, REFUND, LIABILITY (on the Reservation Form):I consent to, acknowledge and agree that:(1) in consideration of making and having a reservation at or staying at Silver Birches Resort ("the resort) any credit/debit card or other information provided by me may be used to assist the owner of the resort in providing additional services or promotional materials to me and in collecting amounts owing by me from my above credit/debit card provider;(2) any damage or loss to the resort property or personnel that is the result of my actions or the actions of persons or pets accompanying myself, or the payment of lodging charges shall be paid for from my above credit/debit card information or myself personally and the owner of the resort in the owner's sole discretion shall be able to deduct, as my agent, the reasonable costs of any repairs or replacement (the reasonableness which shall be determined by the owner of the resort) of the resort property or payment of lodging charges from my above credit/debit card;(3) I AGREE THAT THE MAKING OF AND AGREEING ON A RESERVATION IS AN AGREEMENT TO PAY BETWEEN MYSELF AND THE OWNER OF THE RESORT and I AGREE THAT BY PROVIDING MY CREDIT/DEBIT CARD NUMBER I AGREE TO PAY THE FULL COST OF SUCH RESERVATION acknowleding that the owner of the resort shall suffer monetary damages should I attempt to and get a refund from my credit/debit card provider of my payment and the owner of the resort may, and I further agree, in the owner's absolute discretion, only refund any monies paid or paid through my above credit/debit card only if my reserved spot is re-rented for the same time period minus a 25% administration charge;(4) All persons including myself entering the resort agree to enter at their own risk and the resort and its owners and employees shall not assume any liability for any loss or damage to the property of any guests or any injury to any guest;(5) All guests will notify the resort of any serious medical conditions they have and the owner has the right to deny my reservation because of such serious medical condition;(6) I have explained the above policies to those travelling with me, and; (7) I understand that Silver Birches Resort and its owner and employees are relying on this my said consent, acknowledgement and agreement to pay and the owner and the owner's employees reserve all their legal rights and remedies.
